The Studio Boutique Pilates – Terms & Conditions of Service

This Terms and Conditions Agreement (“Agreement”) governs the relationship between The Studio Boutique Pilates, operating in Alliston and Bradford, Ontario (“the Studio”), and any individual (“Client”) who participates in classes, sessions, or services provided by the Studio. By registering for or attending any Studio classes, sessions, or using its services, the Client acknowledges and agrees to be legally bound by this Agreement.

1. DEFINITIONS

“Services” means all fitness, Pilates, barre, somatic movement, private instruction, and related services offered by the Studio.

“Client” means any individual purchasing, attending, or participating in the Services.

“Instructor” means a qualified individual engaged by the Studio to lead classes or sessions.

2. ASSUMPTION OF RISK & RELEASE OF LIABILITY

2.1. The Client acknowledges that participation in physical fitness activities carries inherent risks, including the risk of injury. The Client voluntarily assumes all such risks.

2.2. The Studio and its owners, employees, contractors, and affiliates shall not be held liable for any injury, loss, damage, or expense incurred by the Client while participating in or attending any Service.

2.3. The Client agrees to release, indemnify, and hold harmless the Studio and its representatives from any and all claims, demands, or causes of action arising out of or in connection with the Client’s participation.

3. HEALTH DISCLOSURE & CLIENT RESPONSIBILITIES

3.1. The Client affirms they are in good health and physically able to participate in the Services provided.

3.2. The Client agrees to promptly disclose any injury, medical condition, or pregnancy to an Instructor prior to participating in any class or session.

3.3. The Studio reserves the right to deny or limit participation if an Instructor, in their sole discretion, determines that a Client’s condition poses a risk to themselves or others.

4. BOOKINGS & ATTENDANCE

4.1. Class reservations must be made in advance via the Studio’s online booking platform or application.

4.2. A Client who arrives more than five (5) minutes after the scheduled start time may be denied entry and marked as a “no-show.”

4.3. Waitlisted clients may be automatically enrolled if a space becomes available. It is the Client’s responsibility to monitor notifications and booking status.

5. CANCELLATION & NO-SHOW POLICIES

5.1. Group Classes

Clients must cancel a minimum of twenty-four (24) hours prior to the scheduled class to avoid a penalty.

Late cancellations and no-shows will result in:

a) the forfeiture of one (1) class credit for clients using class packs or memberships, or

b) the fee paid for a drop-in rate.

5.2. Private Sessions

Must be cancelled with at least twenty-four (24) hours’ notice.

Failure to cancel within this window will result in a full charge for the session.

6. MEMBERSHIP & FEES

6.1. All Services must be paid for in advance. Pricing is subject to change with a minimum of thirty (30) days’ notice.

6.2. Yearly and 6 month memberships are set to auto-renew unless written notice is provided at least seven (7) days prior to the next term billing date. Student memberships do not auto-renew.

6.3. Memberships, class packs, and individual sessions are non-refundable, and can be transferred to family members who are clients of the studio, at the studios sole-discretion.

6.4. Clients may request a temporary membership hold (minimum two [2] weeks, maximum eight [8] weeks per calendar year) for travel or medical reasons. Requests must be made in writing and are subject to approval.

6.5. Class packages and membership have access to both Alliston and Bradford studios.

6.6. An early termination fee of $200 will apply to any cancellation before the agreed term. To request early termination, clients must submit a written request via email to thestudioboutiquepilates@gmail.com.

6.7. When you have entered into an agreement for a minimum membership term, there is a seven (7) day cooling-off period commencing from the date of the agreement. If a written cancellation request is not received within the seven (7) day period, the membership will continue for the agreed minimum term.

7. STUDIO RULES

7.1. Clients must wear clean, indoor grip socks in all classes.

7.2. No food or open beverages are permitted in the studio spaces with the exception of water.

7.3 Mobile phones are not to be used during class and should be set to silent mode.

7.4. Clients are expected to maintain respectful conduct at all times. Any form of disruptive, disrespectful, or harmful behavior may result in suspension or permanent termination of services at the Studio’s sole discretion.

7.5. All personal items should be secured in designated storage areas. The Studio accepts no responsibility for loss, theft, or damage.

7.6. You must be at least 16 years of age to attend class and will require a parent or guardian to sign the waiver.

7.7. Children are not permitted in the studio.

8. TERMINATION OF SERVICES

8.1. The Studio reserves the right to terminate or suspend a Client’s participation at any time, with or without notice, for any breach of these Terms, disruptive conduct, or behavior contrary to the Studio’s values and community standards.

8.2. In such cases, no refunds will be provided for unused classes or time remaining on a membership unless otherwise required by law.

9. COMMUNICATION & PRIVACY

9.1. The Studio collects personal information solely for the purpose of managing bookings, payments, and client safety.

9.2. Personal data will not be sold or disclosed to third parties, except as required by law or as necessary for internal business operations (e.g., scheduling platforms or payment processors).

9.3. By providing an email address or phone number, the Client consents to receive communications related to class bookings, reminders, studio updates, and promotional offers. The Client may opt out at any time.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any legal proceedings arising out of or in connection with this Agreement shall be brought exclusively in the courts of Ontario.

11. AMENDMENTS

The Studio reserves the right to amend this Agreement at any time. Clients will be notified via email.

11.1. The Studio reserves the right to amend, modify, or revise this Agreement, as well as the conditions of memberships, hours of operation, Services offered, fees, and scheduling procedures, at any time and at its sole discretion.

11.2. Any material changes will be communicated via email or on the Studio’s website. Continued use of the Studio’s Services after notice of such changes constitutes the Client’s acceptance of the modified terms.

Acknowledgement and Acceptance

By attending any class or session at The Studio Boutique Pilates, the Client acknowledges that they have read, understood, and agree to be bound by the above Terms & Conditions.
